Veteran lawyer and former Ghana Bar Association (GBA) President, Sam Okudzeto, has criticised the public disclosure of petitions seeking the removal of Chief Justice Gertrude Torkonoo.
According to him, such matters should remain confidential until a prima facie case is established. Speaking on Joy FM’s Top Story on Thursday, March 27, Okudzeto, who also served on the Council of State, described the early publicity as a misstep.
“This should not have been publicised. When I was on the Council, we felt it was wrong for a petition of this nature to be made public before a prima facie case is determined,” he said.
His remarks follow President Mahama’s consultations with the Council of State after receiving three petitions seeking the Chief Justice’s removal.
The Minister for Government Communications, Felix Kwakye Ofosu, confirmed that the petitions have been forwarded in line with Article 146 of the 1992 Constitution.
Meanwhile, two Supreme Court suits have been filed to challenge the process. The Chief Justice has also written to the President, requesting copies of the petitions.
Okudzeto questioned the legality and logic of proceeding without her response. “It’s not just about the law. It’s also about simple common sense. How can the Council of State and the President proceed without input from the accused person?” he argued.
The controversy surrounding the petitions continues to stir debate on due process and judicial independence.
